What is a Bargaining Council?
A Bargaining Council is an independent, statutory Council which is established according mutual  agreements between employer parties and employee parties within the area of jurisdiction, in terms of Section 27 of the Labour Relations Act No. 66 of 1995.

When was the Building Bargaining Council established?
The Building Bargaining Council of North and West-Boland has been in operation since 1956.

How is the Building Bargaining Council governed?
The Building Bargaining Council operate in terms of the Labour Relations Act (LRA) no. 66 of 1995 and is established when employer associations and unions in a particular industrial sector and geographical area agree to engage in collective bargaining.

What are the main functions of a Bargaining Council?
– to equal the playing field for all employers in the industry;
– to negotiate regular wage increases;
– to provide conditions of employment that fits into the structure of the industry;
– conclude and reinforce collective agreements;
– administer benefits like pension/provident funds, sick funds and holiday funds for all employees in the industry;
– prevent and resolve labour disputes;
– manage disputes;
– promote and establish training;
– develop and submit proposals on policies and laws that affect the sector or area.

How do Bargaining Councils extend agreements to non-parties?
The agreements that are reached in the Bargaining Councils are presented to the Minister of Labour and if accepted, it is published as legislation.
Extension to non-parties requires a special application to the Minister of Labour.  The Bargaining Council may extend its Collective Agreement to non-parties, so that all employers and employees in the industry within the specified area are covered.  All parties should abide by these agreements.  The extensions are made in terms of Section 32 of the Labour Relations Act no. 66 of 1995.

The abovementioned Bargaining Council has jurisdiction of the following areas:
The Building Bargaining Council North and West-Boland has jurisdiction in the Magisterial Districts of Ceres, Montagu, Robertson, Tulbagh and Worcester; as well as Overberg District Municipality (excluding Overstrand Local Municipality); Central Karoo District Municipality (excluding the Magisterial District of Beaufort-West); West Coast District Municipality (excluding the Magisterial District of Malmesbury).

`n Bedingingsraad is `n onafhanklike, statutêre Raad wat gestig is as gevolg van onderlinge ooreenkomste wat bereik word tussen werkgewer- en werknemerpartye binne die gebied van jurisdiksie, in terme van Artikel 27 van die Wet op Arbeidsverhoudinge no. 66 van 1995.

Die Boubedingingsraad van Noord en Wes-Boland is reeds in werking sedert 1956.

Hoe word die Boubedingingsraad bedryf?
Die Boubedingingsraad word bedryf in terme van die Wet op Arbeidsverhoudinge (WAV) no. 66 van 1995 en word gestig as werkgewerverenigings en vakbonde in `n bepaalde industriële sektor en geografiese gebied ooreenkom om kollektiewe bedinging.

Wat is die vernaamste funksies van `n Bedingingsraad?
– die speelveld vir alle werkgewers in die bedryf gelyk te stel;
– onderhandeling van gereelde loonverhogings;
– voorsiening te maak vir diensvoorwaardes wat inpas by die struktuur van die bedryf;
– sluit en versterk kollektiewe ooreenkomste;
– administreer eenvormige byvoordele soos pensioen/voorsorgfondse, siektebystand en vakansieverlof;
– verhoed en los arbeidsgeskille op;
– hantering van dispute;
– bevorder en vestig opleiding;
– ontwikkel en bied voorstelle op die beleid en wette wat die sektor of gebied affekteer.

Hoe kry Bedingingsrade uitbreiding van ooreenkomste na nie-partye?
Die ooreenkomste wat Bedingingsrade bereik, word aan die Minister van Arbeid voorgelê en indien dit aanvaarbaar is, word dit as wetgewing gepubliseer. Uitbreiding na nie-partye vereis ‘n spesiale aansoek aan die Minister van Arbeid. Bedingingsrade het die vermoë om die Kollektiewe Ooreenkoms na nie-partye uit te brei, sodat alle werkgewers en werknemers in die bedryf in die spesifieke gebied gedek is. Die ooreenkomste moet deur alle partye nagekom word. Uitbreiding word gemaak in terme van Artikel 32 van die Wet op Arbeidsverhoudinge nr. 66 van 1995.

Die bogenoemde Bedingingsraad het jurisdiksie oor die volgende areas:
Die Boubedingingsraad Noord en Wes-Boland het jurisdiksie oor Landdrosdistrikte van Ceres, Montagu, Robertson, Tulbagh en Worcester; asook Overbergdistrik Munisipaliteit (uitgesluit Overstrand plaaslike Munisipaliteit); Sentraal-Karoo Distrik Munisipaliteit (uitgesluit Landdrosdistrik van Beaufort-Wes); Weskus Distrik Munisipaliteit (uitgesluit Landdros Distrik van Malmesbury).
