BBC North & West Boland Comment on News Article

An article has been published in the Weslander on 24 June 2021 (view article here), indicating that 128 local contractors
submitted a complaint to the Department of Employment and Labour with reference to their view that the BBC North & West Boland is not acting in the best interests of employers and employees in the West Coast region’s building industry.

The Building Bargaining Council North & West Boland operate in terms of the Labour Relations Act (LRA) no. 66 of 1995 and is established when employer associations and unions in a particular industrial sector and geographical area agree to engage in collective bargaining. The agreements that are reached in the Bargaining Councils are presented to the Minister of Labour and if accepted, is published as legislation.
Extension to non-parties requires a special application to the Minister of Labour. The Bargaining Council may extend its Collective Agreement to non-parties, so that all employers and employees in the industry within the specified area are covered. All parties should abide by these agreements. The extensions are made in terms of Section 32 of the Labour Relations Act no. 66 of 1995.

The existing employer parties at the Council is the Master Builders Association Greater Boland with the Building Worker’s Union (BWU) representing the employee parties. Designated agents are employed to monitor or enforce compliance with a collective agreement concluded in the bargaining council by both the employer association and trade union.

The Building Bargaining Council North & West Boland was previously challenged with an objection to the extension of its collective agreement – Please view the Ministry of Employment and Labour’s official response and outcome thereof on 21 December 2020.

This is a clear indication that the collective agreement will be binding on all non-parties in the geographical area including the West Coast area and therefore binding on all employers in the building industry as defined in the North & West Boland region.
